OFFICIAL RULES FOR GRAND PRIZE DRAWING
NO PURCHASE OR PAYMENT NECESSARY. A PURCHASE OF ANY KIND WILL NOT IMPROVE YOUR CHANCES OF WINNING.
1. ELIGIBILITY
The Community Health Challenge Grand Prize Giveaway ("Giveaway") is only open to participants who are legal residents of the states of Minnesota, North Dakota, and South Dakota, who are 18 years of age or older as of their entry date. Sponsor's officers and trustees as well as their immediate family (spouse, parents, siblings and children) are not eligible to win. The Giveaway, and any website pages and advertisements relating thereto, is intended for viewing only within the jurisdictions where the Giveaway is offered. THE GIVEAWAY IS VOID WHERE PROHIBITED BY LAW, AND IS SUBJECT TO ALL APPLICABLE LAWS AND REGULATIONS.
2. AGREEMENT TO OFFICIAL RULES AND DECISIONS
By participating in the Giveaway, each entrant agrees to these Official Rules. Entrants must fulfill all requirements of these Official Rules and the decisions of the Sponsor are final and binding in all respects.
3. Sponsor
The Giveaway is sponsored and administered by Lake Region Healthcare Corporation ("Sponsor" or "LRH"), a Nonprofit Corporation located at 712 S. Cascade Street, Fergus Falls, MN 56537.
4. GIVEAWAY ENTRY PERIOD
The "Giveaway Entry Period" begins at 12:00 a.m. on Sunday April 4th, and ends at 11:59 p.m. Central Standard Time on April 30th (the "Entry Deadline"). This entry period is to allow for eligibility requirements to participate in at least four week's of the challenge to qualify for the grand prize. LRH's computer is the official time-keeping device for the Giveaway.
5. HOW TO ENTER; ODDS OF WINNING
Eligible individuals may enter the Giveaway by visiting www.lrhc.org/150 during the Giveaway Entry Period and follow the registration entry links. Each entrant (sometimes referred to herein as a "Contestant") must completely fill out the registration form. All entries must be submitted online or in person at the Lake Region Healthcare, submitted before the Entry Deadline. Mailed entries will not be accepted. Failure to submit all required information and submissions in the manner required in these Official Rules may result in disqualification. Contestants may only enter the Giveaway once. The odds of winning depend on total number of eligible entries received.
6. Prizes
Subject to the terms and conditions of these Official Rules, one (1) grand prize will be awarded to a randomly selected contestant. The Giveaway winner will be awarded a $1,500 cash prize. Additional cash and/or prizes will be awarded to randomly selected contestants which will be drawn after the grand prize in order to include all participants in the opportunity to win grand prize.
Prizes are not transferable, assignable, or refundable. No cash or other substitution may be made, except by LRH. The prize will be taxable as required by law. The winners must supply the Sponsor with his/her social security number for tax purposes. An IRS Form 1099 will be issued in the name of each Winner for the actual value of the prize received. The prize winner is solely responsible for any and all costs, fees, taxes and expenses associated with prize award, receipt and use, including, without limitation, all federal, state and local taxes on the prize and any travel costs that may be incurred. All prizes must be accepted as awarded, and prize is awarded “AS IS” with no warranty, representation, or guarantee, express or implied, in fact or in law, made by LRH or for which LRH shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE.
7. Publicity
Except where prohibited, participation in the Giveaway constitutes winner's consent to Sponsor's use of winner's name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
8. WINNERS SELECTION; MUST BE PRESENT TO WIN
The Sponsor will select the winner of the Giveaway in a random drawing from all qualified entries received for those present at the LRH Living Well Community Health Expo at Dr. Allen Magnuson Park on June 4th. The drawing will be held at the LRH Living Well Community Health Expo during the Lake Region Run on June 4, 2022, at the Dr. Allen Magnuson Park, Fergus Falls, MN 56537 (the "Draw Location") at approximately 11:45am. (the "Drawing Time"). Eligible participants must be present at the Draw Location at the Drawing Time to win. The winner will be notified in person at the Draw Location. The winner may be required to sign and return an affidavit of eligibility and/or liability/publicity release. LRH, in its sole discretion, may adjust the above timing and delivery requirements to accommodate the Giveaway schedule.
9. Release
By entering, each entrant forever and irrevocably releases and holds harmless LRH, its subsidiaries and affiliates, and their respective agents , prize suppliers, and all of their respective employees, officers, directors, and agents from and against all claims, damages or liabilities arising in whole or in part, directly or indirectly, from entrant's participation and/or entry in the Giveaway; entrant's award, receipt or use of any prize awarded in the Giveaway; and entrant's participation in any prize or Giveaway related activities.
10. LIMITATIONS OF LIABILITY
LRH is not responsible for: (a) incorrect or inaccurate transcription of entry information or late, lost, stolen, unintelligible, illegible, damaged, mutilated, altered, incomplete, misdirected entries or entries received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, web site, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any telephone, mail, website or service; (d) unauthorized intervention in any part of the entry process or the Giveaway; (e) printing, typographical, electronic or human errors which may occur in the offer or administration of the Giveaway or the processing of entries; or (f) any injury or damage to persons or property, including but not limited to entrant's computer, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway, or from viewing, playing or downloading any material from LRH web site, regardless of whether the material was prepared by LRH or a third party, and regardless of whether the material is connected to LRH web site(s) by a hypertext link.
11. WAIVER AND ENFORCEMENT
It is the intent of the Sponsor to have these Official Rules enforced in compliance with applicable law. Sponsor’(s) failure to enforce any term or condition of these Official Rules shall not constitute a waiver of that term or any other term or condition in these Official Rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision of these Official Rules. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision were eliminated from the rules.
12. DISPUTES
Except where prohibited by law, each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Giveaway, or any prizes awarded shall be resolved individually, without resort to any form of class action, and solely and exclusively in a federal or state court located in Otter Tail County, Minnesota; entrant submits to sole and exclusive personal jurisdiction to said courts in the State of Minnesota for any such dispute and irrevocably waives any and all rights to object to such jurisdiction; (b) any and all claims, judgments, and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Giveaway but in no event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
13. RIGHT TO CANCEL OR SUSPEND GIVEAWAY
If for any reason the Giveaway is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of LRH that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, LRH reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Giveaway.
14. GOVERNING LAW
The Giveaway is governed by the laws of the State of Minnesota, without regard to any choice of law provisions. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor(s) in connection with the Giveaway and/or any Prize, shall be governed by, and construed in accordance with, the laws of the State of Minnesota without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota.
The Giveaway, or elements of the Giveaway, may be void where prohibited by law. Entrants are instructed to check local laws or regulations for any restrictions or limitations regarding participation in the Giveaway. Everything concerning the Giveaway, including everything on the Sponsor's website, is provided "as is," without warranty without any kind, express or implied.
15. DATA PRIVACY
Entrants agree that personal data, especially name and address, may be processed, shared and otherwise used for the purposes and within the context of the Giveaway and any other purposes outlined in these Official Rules. The data may also be used by the Sponsor in order to verify the participant’s identity, postal address and telephone number or to otherwise verify the participant’s eligibility to participate in the Giveaway. Participants have the right to access, review, rectify or cancel any personal data held by Sponsor by writing to Sponsor at 712 S. Cascade Street, Fergus Falls, MN 56537. Personal data will be used by Sponsor and its affiliates exclusively for the purposes stated herein.
16. WINNERS LIST/OFFICIAL RULES
For a list of winner and/or copies of the Official Giveaway Rules, send a self-addressed, stamped envelope to: Lake Region Healthcare, Attn: Katie Johnson, 712 S. Cascade Street, Fergus Falls, MN 56537. All such requests must be received within six (6) weeks after the end of the Giveaway. These Official Rules will be posted on the Website during the Giveaway Period.
